AT&T Online Terms of Use

1. INTRODUCTION

These websites are operated by subsidiaries and affiliates of AT&T Inc. (“AT&T,” “we,” “our,” or “us”). Our sites offer a wide range of resources, products, and services, including shopping, branded and personalized content, entertainment, communication tools, online directories, administrative services, downloads, advertising, games, and information (collectively, the “Site” or “Sites”). The terms “you” or “your” include your subsidiaries, affiliates, employees, and parent or legal guardian.

Please Read These Terms Carefully
By accessing or using our Site, you agree to comply with these Terms of Use, including all policies and guidelines incorporated by reference (collectively, the “Terms”). Some services, particularly subscription or paid services, may have their own terms and conditions that govern your use of that service.

These Terms do not change or override any other agreements you may have with AT&T, including other website terms of use with an AT&T affiliate. If there is a conflict between these Terms and any other service-specific terms or agreements, the service-specific terms will govern.

2. AUTHORITY

By using our Site, you confirm that you are at least 13 years old. Users between the ages of 13 and 18 may only access the Site with the consent of a parent or legal guardian. By using the Site, you represent that you are either 18 or older, or that you have such parental or guardian consent, and that you are fully able and competent to agree to these Terms. If you do not meet these requirements, please exit the Site.

AT&T recommends using any access controls provided on the Site or by third-party sites to help limit or block content that may be inappropriate or harmful to minors.

3. Modifications to the Terms or the Site

AT&T may update or modify these Terms at any time by posting the revised Terms on the Site. The updated Terms become effective immediately upon posting. Your continued use of the Site after changes indicates your acceptance of the updated Terms.

AT&T also reserves the right to change, modify, or discontinue the Site—or any part of it—temporarily or permanently, including any content, without notice. You agree that AT&T is not liable to you or any third party for any such changes, modifications, or discontinuation of the Site or its content.

4. Account Registration, Passwords, and Security

When you provide information on our Site, you agree to:

  1. Provide true, accurate, current, and complete information.

  2. Maintain and promptly update your information to keep it accurate and complete.

If any information you provide is, or is reasonably suspected to be, untrue, inaccurate, outdated, or incomplete, AT&T may suspend or terminate your access to the Site without notice and deny any current or future use of the Site (or any part of it).

For portions of the Site requiring registration or account creation, you may be asked to choose a username and password. You should select a password that is not easily guessable and change it regularly. You are responsible for keeping your password and account information confidential and for all activities that occur under your account. You agree to immediately notify AT&T of any unauthorized use of your account, password, or other security breaches.

AT&T may take any reasonable actions to maintain the security of the Site and your account, including terminating your account, changing your password, or requesting additional information to authorize account transactions. AT&T may rely on the authority of anyone accessing your account with your credentials, and AT&T is not liable for any damages or losses resulting from:

  • Actions or inactions taken by AT&T to maintain security

  • Any compromise of your account or password

  • Unauthorized access to or use of your account

You may not use another person’s account without their permission.

Security of Personal Information
We take reasonable measures to help protect your personally identifying information. However, no system can guarantee perfect security. You acknowledge that AT&T cannot guarantee the Site is free from viruses, security threats, or other vulnerabilities, and we make no warranty or representation that the Site is completely secure.

5. PRIVACY POLICY

Please review our Privacy Policy, which explains how AT&T collects and uses information through or in connection with our Sites. AT&T’s use of your information is always governed by the Privacy Policy, which is incorporated into these Terms.

If you are using about.att.com or the AT&T Discovery District site, those sites are governed by a separate privacy policy. By using these Sites, you consent to the collection and use of your information as described in the applicable privacy policy.

6. COPYRIGHT AND AUTHORIZATION

The Sites provide access to a wide range of information, shopping, communications, entertainment, games, advertising, and other services, products, data, and materials (collectively, “Content”). Some Content is owned by AT&T Intellectual Property II, L.P. and its affiliates, while other Content is owned by third parties, including suppliers, vendors, licensors, or users (as described in Section 11).

Certain parts of the Site may require you to download software (“Software”) to access the Site, its services, or Content. This Software may be owned by AT&T or by AT&T’s suppliers, vendors, or licensors. Both the Content and Software are protected by copyright, trademark, patent, and trade secret laws.

Subject to the Terms and any stated limitations, AT&T grants you a limited, non-sublicensable right to access the Sites, Content, and Software for personal, non-commercial use only, unless otherwise permitted.

You may not download, export, or re-export any Software or underlying technology:

  1. To countries subject to U.S. embargoes, including Cuba, North Korea, Iran, Sudan, Syria, or any other restricted country.

  2. To individuals or entities listed by the U.S. Treasury Department (e.g., Specially Designated Nationals) or U.S. Commerce Department (e.g., Entity List, Table of Deny Orders).

By downloading or using the Software or technology, you agree to these restrictions and represent that you are not located in, under the control of, or a national/resident of any prohibited country or listed entity.

7. Copyright Infringement Notices

AT&T respects the intellectual property rights of others. Under the Digital Millennium Copyright Act of 1998 (DMCA), 17 U.S.C. §§ 512(b)–(d), a copyright holder may send AT&T a valid notification if they believe their copyrighted work has been copied and posted, stored, or transmitted on the Sites in a way that infringes their copyright.

8. Ownership of Trademarks and Service Marks

Trademarks displayed on the Sites, including AT&T and the Globe Logo, are owned by AT&T Intellectual Property or by third parties offering products or services on or through the Sites.

AT&T trademarks, graphics, logos, button icons, scripts, and page headers may not be copied, used, or modified without prior written permission from AT&T Intellectual Property or, if applicable, its licensor.

Other trademarks, service marks, registered trademarks, product and service names, and company logos appearing on the Sites are the property of their respective owners, who may or may not be affiliated with or sponsored by AT&T.

You may not use any AT&T names, trademarks, or product names in meta tags or hidden text without AT&T’s express written consent.

The BLUETOOTH® word mark and logos are registered trademarks of Bluetooth SIG, Inc., used by AT&T under license. All other trademarks and trade names belong to their respective owners.

9. Third-Party Products and Services

Some products and services on or accessible through the Sites are offered by parties other than AT&T. Except for AT&T-branded products, services, or information explicitly identified as provided by AT&T, AT&T does not operate, control, or endorse any third-party products, services, or content. AT&T makes no warranties regarding these offerings and is not responsible for their content, actions, or practices. You should review the privacy policies and terms of use of any third-party sites you visit.

The Sites may also contain links to websites not operated by AT&T. These links are provided for convenience only and do not indicate affiliation, endorsement, or approval by AT&T. AT&T is not responsible for the content, links, or privacy practices of any linked website. Accessing third-party websites is done at your own risk, and you should carefully review their terms, policies, and data practices.

10. Information About Products and Services

AT&T does not guarantee that the information, graphics, product or service descriptions, or other content on the Sites is accurate, complete, reliable, current, or error-free. Despite our efforts, product or service prices and descriptions may contain errors.

If AT&T identifies an inaccuracy in a product or service description or price, we may take any reasonable action to correct it, including canceling your order, unless prohibited by law. AT&T may also update or change content, products, services, or programs on the Sites at any time without notice.

You agree to notify AT&T immediately if you notice any pricing or description errors and to comply with any corrective action AT&T takes.

11. ONLINE ORDERS

To protect AT&T and our customers from fraud, we may implement reasonable procedures for online orders. This can include verifying the information you provide or limiting the quantity of equipment (e.g., wireless phones) or services that a single individual or entity may order.

AT&T reserves the right, at its sole discretion, to further limit quantities or to cancel or reject any order.

12. USER SUBMITTED CONTENT

Some areas of the Site, such as message boards, forums, member profiles, directories, job listings, or similar features, allow users to post content that is visible to the public or other users (“publicly accessible areas”).

When you post content—such as messages, images, text, photos, graphics, audio, or video—in these areas:

  • You retain your ownership rights.

  • You grant AT&T a royalty-free, perpetual, irrevocable, non-exclusive, and sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display your content worldwide in any form or media now known or developed in the future.

  • You also allow other users to view, store, share, reproduce, or create derivative works from your content.

  • No compensation will be paid for posting or using your content.

  • AT&T is not obligated to post or use your content and may remove it at any time.

  • You agree that AT&T has no confidentiality obligations regarding your content.

  • You represent and warrant that you own or control all rights to the content, that it is accurate, and that posting it does not violate these Terms (including Section 14 on Acceptable Use) or harm any person or entity. You agree to indemnify AT&T for any claims arising from your content.

AT&T does not pre-screen or control user content and does not guarantee its accuracy or quality. AT&T may, at its sole discretion, monitor, refuse, or remove any content for any reason, including violations of these Terms or if it is otherwise objectionable.

AT&T assumes no responsibility or liability for user-generated content, including any mistakes, defamation, slander, libel, obscenity, pornography, or offensive material. As a provider of the Site, AT&T is only a forum and is not responsible for statements, representations, or content posted by users. Opinions, advice, or recommendations expressed by users are their own and do not reflect AT&T’s views or endorsements.

While AT&T does not intend to limit free expression, we reserve the right to take action when content is harmful, inflammatory, or used to spread objectionable statements.

13. SUBMISSIONS TO AT&T

You agree not to submit ideas, concepts, proposals, inventions, methods, or techniques for new or proposed products or services (collectively, “Submitted Material”) through the Site.

If you do submit any such material, you grant AT&T a perpetual, worldwide, irrevocable, non-exclusive, royalty-free license to use, reproduce, modify, distribute, or display your Submitted Material in any way, without compensation or attribution to you. AT&T may also use your name in connection with the Submitted Material for advertising, marketing, or promotional purposes.

AT&T is not obligated to maintain confidentiality regarding any Submitted Material. You agree that you will have no claims against AT&T for infringement or misappropriation of any rights in your Submitted Material. By submitting material, you also waive any “moral rights” you may have in it.

You represent and warrant that:

  • You own or control all rights to the Submitted Material.

  • The Submitted Material is accurate.

  • Submission of the material does not violate these Terms or cause harm to any person or entity.

14. ACCEPTABLE USE

You agree to use the Site, its Content (whether provided by AT&T or others), and any related Software in compliance with all applicable laws and regulations. You may not use the Site or Software to post, upload, distribute, or transmit content, or engage in activities that:

  • Are illegal, harmful to minors, threatening, harassing, abusive, defamatory, obscene, pornographic, violent, offensive, hateful, or invade someone’s privacy.

  • Infringe another person’s intellectual property rights, including patents, copyrights, trademarks, or trade secrets.

  • Remove proprietary notices or labels from Content.

  • Encourage or solicit violence, criminal activity, or violations of local, state, national, or international law.

  • Are deceptive, fraudulent, or misrepresent your identity or affiliation.

  • Advertise firearms, ammunition, tobacco, alcohol, illegal drugs, or other prohibited products.

  • Constitute unsolicited or unauthorized advertising, spam, chain letters, or bulk communications.

  • Interfere with other users’ ability to use the Sites or participate in forums or groups.

  • Contain viruses, malware, Trojan horses, or other harmful code.

  • Involve pyramid schemes, petitions, or unauthorized charity requests.

  • Use robots, spiders, or automated tools to extract or monitor Site content.

  • Create false identities to mislead others.

  • Collect or distribute user information or usage data without permission.

  • Use AT&T domain names deceptively as return email addresses.

  • Post content or advertisements outside designated areas.

  • Provide material support to organizations designated as foreign terrorist organizations under U.S. law.

  • Attempt to bypass, disable, or circumvent security tools or digital rights management.

  • Copy, reproduce, sell, trade, or exploit any portion of the Site or Content for commercial purposes.

  • Publish or distribute Content to third parties, including via broadcast or network distribution.

  • Systematically collect or mine data from the Site.

  • Make derivative works from the Site or its Content.

  • Use framing or similar techniques to enclose or present Site content as your own.

  • Reverse engineer, decompile, disassemble, or attempt to derive the source code or underlying technology of the Site.

Unless a part of the Site specifically encourages anonymity, we encourage you to use your real name.

15. SITE SECURITY

Violating the security of the Site is strictly prohibited and may result in civil or criminal liability. AT&T may investigate security incidents and will cooperate with law enforcement if a criminal violation is suspected.

Examples of prohibited security violations include, but are not limited to:

  • Unauthorized access to or use of Site data or systems.

  • Probing, scanning, or testing the Site for vulnerabilities or attempting to bypass security or authentication measures.

  • Unauthorized monitoring of Site data or traffic.

  • Interfering with the service or network of any user, host, or system, including techniques like mail bombing, news bombing, flooding, or deliberately overloading systems.

  • Forging TCP/IP packet headers, email headers, or any part of a message header (except for authorized aliases or anonymous remailers).

  • Using any manual or automated method to bypass Site usage limitations.

16. Location-Based Restrictions

Unless explicitly stated otherwise, this Site is intended for use only by individuals located within the United States. Some AT&T subsidiaries or affiliates provide regulated telecommunications and other services only in certain areas of the U.S.

AT&T does not guarantee that all products, services, or content on the Site are appropriate or available outside the U.S. or in all U.S. territories. If you access the Site from outside the U.S., you do so on your own initiative and are responsible for complying with local laws.

Certain AT&T affiliates operate websites in other countries. If you visit these international sites (some of which may be linked from this Site), their own terms of use and privacy policies apply, not these Terms.

17. General Policies on Use and Data Storage

AT&T may set general rules and limits for using the Site, including:

  • How long email messages, forum posts, or other uploaded content are retained.

  • The maximum number or size of email messages you can send or receive.

  • The amount of disk space allotted on AT&T’s servers for your account.

  • How often and for how long you may access the Site in a given period.

By using the Site, you consent to AT&T storing your electronic communications on its servers. AT&T is not responsible for the loss or deletion of any messages, communications, or other content.

AT&T may also terminate accounts that remain inactive for a long period. These general practices and limits may be modified at any time at AT&T’s discretion.

18. DISCLAIMER OF WARRANTIES

You expressly understand and agree that:

  • Your use of the Site, including any content, services, or software provided, is at your own risk. The Site, any related services, content, or software are provided “as is” and “as available”.

  • AT&T, its co-branders, suppliers, licensors, and related parties, including their officers, agents, and employees, expressly disclaim all warranties, whether express, statutory, or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, title, or non-infringement. Some jurisdictions may not allow the exclusion of certain warranties, so these disclaimers may not apply to you.

AT&T and its affiliates make no warranty that:

  1. The Site will meet your requirements.

  2. Content, materials, or software available for download are free of viruses, malware, worms, Trojan horses, or other harmful code.

  3. The Site will be uninterrupted, timely, secure, error-free, or provide continuous storage or access.

  4. The results you obtain from using the Site will be accurate, complete, or reliable.

  5. The quality of any products, services, software, information, or materials obtained through the Site will meet your expectations.

  6. Errors in the Site or software will be corrected.

Any material downloaded, uploaded, or obtained through the Site or software is done at your own discretion and risk, and you are solely responsible for any damage to your computer, data loss, or other harm that may result.

No advice or information, whether oral or written, obtained from AT&T or through the Site, creates any warranty. You should not rely on advice or information from the Site for significant personal, business, medical, legal, or financial decisions. Consult an appropriate professional for guidance tailored to your specific situation.

19. ENFORCEMENT

AT&T reserves the right, but is not required, to enforce these Terms. This may include actions such as:

  • Issuing warnings, suspending, or terminating access to the Site or services.

  • Removing, screening, or editing Content.

  • Conducting investigations, or pursuing litigation or other legal action in any appropriate venue.

AT&T may access, use, and disclose your transaction information or Content to:

  • Comply with legal obligations (e.g., subpoenas).

  • Enforce our agreements, including these Terms.

  • Initiate, render, bill, and collect for services.

  • Protect our rights, property, or users of the Site and other AT&T services.

  • Prevent or address fraudulent, abusive, or illegal activity.

Any indirect, attempted, or actual violation of these Terms by you—or by any third party acting on your behalf—will be considered a violation by you.

20. LIMITATION OF LIABILITY

To the fullest extent permitted by law, AT&T and its employees, officers, representatives, service providers, suppliers, licensors, and agents are not liable for any damages of any kind, including direct, indirect, incidental, special, exemplary, punitive, or consequential damages. This includes, but is not limited to:

  • Loss of use, profits, or data.

  • Errors, omissions, or inaccuracies in the Site’s content, materials, software, information, products, or services.

  • Costs for substitute goods or services resulting from purchases or transactions through the Site.

  • Unauthorized access to or alteration of your transmissions or data.

  • Statements or actions of any third party on the Site.

  • Delays or failures caused by force majeure events, including natural disasters, wars, strikes, labor disputes, terrorism, vandalism, communication failures, or any other events beyond AT&T’s reasonable control.

Even if AT&T or its representatives were advised of the possibility of such damages, your sole remedy for dissatisfaction with the Site or its services is to stop using the Site or services.

Some jurisdictions may not allow the limitation of liability, exclusion of certain damages, or limitation of implied warranties, so some of these limitations may not apply to you.

If any part of this limitation is found invalid or unenforceable, AT&T’s total liability in such cases will not exceed $100.

21. INDEMNIFICATION

To the extent allowed by law, you agree to indemnify, defend, and hold harmless AT&T, its content and service providers, licensors, suppliers, and their subsidiaries, affiliates, officers, agents, and employees from any losses, expenses, damages, or costs (including reasonable attorneys’ fees) resulting from:

  • Any content you submit, post, upload, or transmit through the Site.

  • Your use of or connection to the Site.

  • Your violation of these Terms.

  • Your violation of any law or the rights of another person.

These obligations remain in effect even after your relationship with AT&T ends or you stop using the Site.

AT&T may, at its discretion, assume control of the defense of any claim subject to your indemnification, and you agree to cooperate with AT&T in asserting any available defenses.

22. TERMINATION/SUSPENSION

You agree that AT&T may immediately terminate or suspend your account, email address, and access to all or part of the Sites, or change your password without notice. Reasons for termination or suspension may include, but are not limited to:

  • Violations of these Terms or any incorporated agreements or guidelines.

  • Requests from law enforcement or government agencies.

  • Your request to delete your account.

  • Discontinuation or major changes to the Sites (or parts of them).

  • Technical or security issues.

  • Extended periods of inactivity.

  • Engagement in fraudulent or illegal activities.

Termination or suspension may involve:

  • Removal of access to Site offerings.

  • Deletion of your password, account information, files, and other content.

  • Prohibition of further use of the Sites.

You acknowledge that all terminations and suspensions are at AT&T’s sole discretion, and AT&T is not liable for any termination, suspension, loss of storage, email address, or access to the Sites.

AT&T also reserves the right to terminate or suspend accounts at any time, for any reason, and without notice, at its sole discretion.

23. MISCELLANEOUS

  • No Waiver: AT&T’s failure to enforce any right or provision in these Terms does not mean AT&T waives that right.

  • Severability: If any part of these Terms is found to be illegal, invalid, or unenforceable, that part can be removed without affecting the rest of the Terms.

  • Governing Law: These Terms are governed by the laws of the State of Texas. Any legal action or dispute between you and AT&T regarding these Terms must be brought exclusively in a federal or state court in Texas.

  • No Modification by Conduct: Past behavior, dealings between the parties, or trade practices cannot change these Terms.

  • Assignment: AT&T may assign its rights or obligations under these Terms to any party at any time without notice. You may not assign your rights or obligations without AT&T’s written consent.

  • No Third-Party Rights: These Terms do not give any third party the right to make a claim or receive reimbursement.

  • Time Limit for Claims: Any claim or legal action related to the Site must be filed within one year after it arises.
